In the wake of the Supreme Court’s landmark decision in United States v. Arizona, courts have been issuing decision that have weakened state efforts to impose their own immigration law enforcement schemes. This paper provides an update on legal challenges that have been brought against immigration enforcement laws enacted in Arizona, Utah, South Carolina, Alabama, Georgia and Indiana.

This paper looks at ICE’s Secure Communities program, examines program statistics that show a plurality of persons arrested by ICE through the Secure Communities program have no criminal history—contradicting the program’s stated objective to focus on the most serious criminal offenders. The paper also reviews the controversy over the ability of local jurisdictions to opt out of the program, and makes a series of recommendations.

This memo summarizes a Department of Homeland Security Office of Inspector General (OIG) report on the 287(g) program operated by Immigration and Customs Enforcement (ICE). The 287(g) program provides authority for state and local law enforcement to enforce immigration laws. Six months after it released a report highly critical of the 287(g) program, the OIG found that ICE had still not implemented 28 of 33 recommendations made by the OIG in March 2010.
